R v Company Director

An individual director of an Essex-based hazardous waste disposal company was charged under Section 36 of the HASAWA, after a worker was crushed beneath a tracked excavator at a sorting and recycling site.

Landowner v Supplier of Compact Tractors

This was a multi-million pound settlement. We acted as an expert witness for the claimant concerning the stability of a newly purchased compact tractor that overturned whilst descending a slope. Expert evidence was around the behaviour of vehicles on hard, grass slopes and the effects of counterweights and attached front-loaders.

Birmingham City Council v Supermarket Chain

In this case we worked as an expert witness for the prosecution. This arose from a death in a warehouse where a forklift truck driver was crushed between the mast and overhead guard.

R v Steel Stockholder

We were the expert witness for the defence in this case. We worked under Section 3 of the HASAWA when a lorry driver was killed on the public highway while unloading steel tubes with a forklift truck.

Widow of Deceased v Supplier of Granite Worktops

We worked as an expert witness for the deceased’s family. The case arose from the collapse of a load suspended from an overhead gantry in an Essex farm.

R v Company Directors

Defendants were charged with health and safety and perverting course of justice. We worked to advise the court on health and safety responsibilities of the various duty holders and the requirements for operator training under Approved Code of Practice L24 – Lift Trucks.

Family of Deceased v Stone Company, Bath

We were the expert witness for the claimant in the case of an overturned forklift truck in a stone cutting factory. Evidence provided concerned the stability of un-laden trucks and the effects of lack of tyre tread.

Family Farming Business v Manufacturer

Regarding a JCB Model 531-70 Agri-Super Telehandler. Tests to investigate the sudden dropping of the boom under bucket tipping conditions; including a specialist scheme of work and risk assessment for the tests.

R v Stevedore Company, Cardiff Docks

We were the expert witness for the defence in a prosecution arising from an amputation to a lorry driver whilst handling steel at Cardiff Docks. The company were prosecuted under Sections 2 and 3 of the HASAWA.

R v Scottish Shooting Estate

We acted as an expert for the defence in a prosecution arising from a death from an overturn of a ride-in Kubota All Terrain Vehicle. We discovered expert evidence given around vehicle stability and the use and enforcement of the wearing of lap belts.

HSE v Timber Importers, Ipswich Docks

This was an appeal of prohibition notice against a multi-FLT lifting operation. The employment judge granted a suspension of the notice for the duration of the tests. The appeal was successful, subject to safeguards recommended in our report.

HSE v Construction Company

This was a successful appeal of a Prohibition Notice regarding the work of a contractor on a construction site. It concerned the manual handling of kerb stones.
